Hernia Mesh Updates: Bard Trial and FDA’s Pros and Cons
Santa Clara, CAC.R. Bard’s request to replace the final two bellwether hernia mesh injury cases previously selected for trial, arguing that the claims are no longer representative of other claims pending in the litigation, were denied by U.S. District Judge Sargus. Bard’s reasoning is that plaintiffs’ injuries have worsened since filing their complaints: pain has advanced to severe injury.

Two California Public Water Utility Attorneys Awarded $6 million
San Francisco, CATwo attorneys who filed a racial discrimination complaint and then a retaliation complaint against their former employer, East Bay Municipal Utility District (EBMUD, also known as East Bay MUD), were awarded $6 million. After the California Labor trial in June before Judge Alex Tse, the jury agreed that the former employees, one Asian-American and the other African-American, were retaliated against after they complained about racial discrimination. They were both forced to resign. And EBMUD has a history of discrimination complaints.

Philadelphia’s Roundup Lawsuits get Trial Dates and New York Settlement
Philadelphia, PA The first Philadelphia Monsanto Roundup bellwether case is set to begin jury selection in early October, a decision that plaintiffs’ attorney say is good for everyone involved. And in June, Bayer and Monsanto agreed to settle with New York for close to $7 million.

Balkan Workers Allege Tesla Denied California Overtime
Fremont, CA A California federal judge has ruled that over 100 Balkan workers employed at Tesla’s facility in Fremont can proceed with an overtime class action. According to Judge Beth Labson Freeman, there is enough evidence to imply that the workers were paid flat monthly wages without overtime, a California labor law violation. Tesla is gaining a reputation for overtime lawsuits.

Home Depot Wages Settlement
San Francisco, CA A Home Depot wage & hour class action lawsuit is seeking preliminary approval of a $72.5 million settlement, which will resolve allegations of unpaid off-the-clock work. The complaint was brought under California's Private Attorneys General by the home improvement company’s workers going back to early 2016 and a trial was slated for this year. The preliminary California labor settlement was filed last month in a San Francisco federal court and covers more than 272,000 people employed by Home Depot in the state since March 8, 2012.
