COVID-19 accelerates arbitration’s move online

In May last year, six international law firms combined forces to create a set of universal best-practice arbitration guidelines. But Herbert Smith Freehills, Ashurst, CMS, DLA Piper, Hogan Lovells and Latham & Watkins were not aware that they would be releasing the draft protocol, which is out for consultation this month, in such a different climate.

How the arbitration landscape will shift in the coming days remains to be seen, but the impacts of the coronavirus pandemic will doubtlessly have an impact — virtual disputes have grown more pronounced and the use of technology has spiked.

BCLP becomes latest international firm to announce Beijing closure

Anglo-American law firm Bryan Cave Leighton Paisner (BCLP) has recently announced that it will close its Beijing office, making it the third international firm after Stephenson Harwood and Vinson & Elkins to declare its intention to exit the Chinese capital in the past two months.

Rohan Raichaudhuri is regional general counsel for the Asia-Pacific at Sigfox, a French service provider for the Internet of Things industry. Having started his career in India with law firms New Delhi Law Offices and HSA Advocates, he has worked in Singapore since 2008, first in private practice with WongPartnership, before holding in-house roles at Starwood Hotels & Resorts, IBM and Accenture. Raichaudhuri has been with Sigfox since 2016.

Restructuring as an Option for Indonesian Limited Liability Companies to Mitigate the Impact of COVID-19 Outbreak [Brought to you by AZP]

The first case of Corona Virus Disease 2019 (“COVID-19”) in Indonesia was confirmed in early March of 2020. Since then, due to the rapid spread ofCOVID-19 among the Indonesian people, the Government of Indonesia (“GoI”) has issued new regulations as part of its efforts to stop the COVID-19 outbreak within the country, inter alia, (i) the Presidential Decree No.11 of 2020 concerning the Determination of Public Health Emergency regarding COVID-19 on 31 March 2020; (ii) the Government Regulation No. 21 of 2020 concerning Large-Scale Social Restrictions for Acceleration in the Handling of COVID-19 on 31 March 2020; and (iii) the Minister of Health Regulation No. 9 of 2020 concerning Guidelines on the Large-Scale Social Restrictions for Acceleration in the Handling of COVID-19 on 3 April 2020.

Indonesian Bankruptcy and PKPU Proceedings in a Time of Covid-19 [Brought to you by SSEK]

The COVID-19 pandemic has caused more economic harm to Indonesia than the subprime mortgage crisis in 2008. As part of efforts to check the spread of the virus, the Indonesian government has implemented a policy of Large-Scale Social Restrictions (Pembatasan Sosial Berskala Besar or “PSBB”), requiring most businesses to cease or at least pare down activities. The Indonesian Chamber of Commerce and Industry stated on May 1, 2020, that the number of employee terminations due to the pandemic was approximately 15 million, not the 2 million reported by the Indonesian Ministry of Manpower and Transmigration.
