After 12 years of waiting, China finally issued its 4th version of the Patent Law on 17 October 2020, which introduces higher penalties for patent infringements, administrative enforcement measures, and new Patent Term Adjustment/Extension and Patent linkage systems. With the amended law taking effect soon, legal experts share insights on its effects on both companies and law firms.

On 10 November, China’s State Administration for Market Regulation published draft rules aimed at preventing monopolistic behaviour by internet platforms, a move that will increase scrutiny on e-commerce marketplaces. The draft rules provide clear restrictions on behaviours like limiting brands from selling on multiple platforms and treating customs differently based on big data. We speak to experts on their interpretations of the rules and advice for affected companies.
