Another Sex Abuse Lawsuit Filed After University of Michigan’s $490 million Settlement
Detroit, MI An elderly Michigan man has filed a federal lawsuit against the University of Michigan claiming he too was a victim of sexual abuse by the late university sports doctor Robert Anderson. His complaint comes just days after the university agreed on a settlement to end the biggest sex abuse scandal in the U.S. that involved approximately 1,050 victims.

United Airlines Pilots and Flight Attendants Seek Summary Judgment in Pay Stub Fight
Los Angeles, CA – On January 12, United Airlines pilots and flight attendants asked the Central District of California to find that the pay statements they received from the airline violate section 226 of the California Labor Code because the statements do not include hourly rates or hours worked and are not easily understandable. Felicia Vidrio v. United Airlines Inc., a class action lawsuit, was dismissed by the same court in 2017. The decision now appears ripe for reconsideration following the Ninth Circuit’s 2021 decision in Ward v. United Airlines.

CPAP Sleep Machines Kidney Cancer Lawsuit
Pittsburgh, PA Yet another CPAP lawsuit against Philips alleges the toxic foam used in its System One BiPAP device causes cancer. Joseph Martin’s kidney cancer, and the company knew about the problem with its 15 million DreamStation devices, CPAP, BiPAP and mechanical ventilators since at least 2015, at least two years before Martin was diagnosed with kidney cancer. And like countless sleep machine users, Martin didn’t make the connection to cancer until the recall.

ERISA Lawsuit Nets Nearly $9.4 Million for Plan Participants
St. Paul, MN The U.S. Department of Labor has announced an agreement to settle Walsh v. Reliance Trust Co. that will restore nearly $9.4 million to participants in the Kurt Manufacturing Company Employee Stock Ownership Plan (ESOP). The ERISA lawsuit alleged that plan fiduciaries caused the ESOP to buy all the outstanding company stock for nearly $10 million more than it was worth. The sellers of the stock included company directors and the chairman of the board. The DOL claimed that the sellers either knew or should have known that the price was significantly inflated.

Canadian Class Action Accuses Sorin Heater-Cooler System Makers of Failure to Warn
Toronto, ON A class action lawsuit certified by an Ontario Superior Court judge accuses LivaNova (formerly Sorin), the manufacturer of Sorin 3T Heater-Cooler System, a medical device used to regulate the temperature of fluids during open heart surgeries, of failure to adequately warn hospitals of severe infection risk to open-heart surgery patients.
