Minnesota District Court Dismisses ERISA Fiduciary Breach LawsuitSt. Paul, MN On August 21, the federal District Court for the District of Minnesota dismissed – for a second time-- an ERISA lawsuit brought by participants in the Taylor Corporation’s 401k and profit-sharing plan. The decision in
Fritton v. Taylor Corp. concludes that the participants did not meet the requirements of what it termed “the meaningful benchmark standard.” The District Court is not the only court to apply this standard.
Maryland’s Largest Water Utility Files PFAS LawsuitGreenbelt, MD On August 4, Maryland’s largest water utility, the Washington Suburban Sanitary Commission (WSSC), filed a perfluoroalkyl and polyfluoroalkyl (PFAS/PFOA) lawsuit against 3M and DuPont de Nemours among other defendants.
Washington Suburban Sanitary Commission v. 3M Company alleges that the PFAS manufacturers made and marketed PFAS-contaminated fire-suppression foams and concealed the toxic nature of the materials from the public.
