Brigard Urrutia’s TMT team presents the report “Regulatory Trends and Personal Data 2024-2025,” which compiles the latest statistics on decisions published by the Superintendence of Industry and Commerce (SIC) in 2024 and 2025. The data confirm that SIC is a prolific authority in this area: in 2024, it imposed fines totaling more than three billion pesos, a 42% increase compared to 2023, and 97% of those sanctions were imposed on data controllers. Additionally, approximately 1 out of every 10 information requests escalated to a formal investigation during that same year, demonstrating how quickly a simple request can turn into a sanctioning process. Looking ahead to 2025, nearly half of the sanctions are due to the lack of authorization from data subjects, which shows that consent remains the most critical aspect of compliance. These statistics send an unequivocal message: having clear procedures, evidence of consent, and security programs appropriate to the level of risk is not optional, but a legal obligation. Our TMT team is ready to support organizations in planning and implementing policies and manuals, assessing personal data processing activities, conducting risk assessments, managing incidents, and representing clients before SIC.
