Can you trademark a Cajun last name?

Can you trademark a popular Cajun surname?

One notable Texas business thinks it can and is going to court to do so. Landry’s LLC, the Houston-based restaurant chain that is owned by President & CEO Tilman Fertitta, has filed suit against Austin-based Landry Distillery, a company started by New Iberia native Zachary Landry, over the trademark issue.

Landry’s officials sent a cease-and-desist letter over the issue almost immediately after Landry launched the brand in August 2021. It's been moving through the courts systems in Texas since.
