Question of the Week | Tuesday we asked: The Massachusetts House approved a bill last week that restricts the use of non-compete agreements. The bill would limit the length of non-compete agreements in most circumstances to 12 months and prohibit employers from enforcing the agreements on minimum-wage workers, college students or employees 18 and younger. | Do you support reining in non-compete clauses? | | I am a consultant who encounters non-compete clauses all the time. I rarely work with Massachusetts companies because they have such restrictive clauses that I could never sign them. It is ironic that though I live near Worcester I do most of my work for firms in other parts of the US or in the EU, due to the idiotic attitudes of non-compete in the state. Should be restricted to proprietary information including customer lists, IP, trade secrets, etc. A person makes a reputation in a chosen field. A non-compete essentially takes away their ability to work in their chosen field. Frankly, that's a restraint of trade that kills off the right to work.
