Bitwise Lawsuit Alleges WARN Act ViolationFresno, CA Over 100 furloughed Bitwise Industries employees have file a class action lawsuit against the tech company for violating the WARN Act and other California labor law violations. The workers claim they were not provided written notices of their furloughed status, and that Bitwise failed to notify the Economic Development Department and the City of Fresno of the mass layoffs. On May 30, Bitwise Industries announced it is furloughing its entire workforce.
Family Feud Savages ESOP Participants’ Retirement FundNewark, NJ On May 9, former participants in the Asbury Carbons, Inc. Employee Stock Ownership Plan (ESOP) filed a class action ERISA lawsuit in the District of New Jersey.
Lance Miller and Larry Richardson et al. v. Neil Brozen, Asbury Carbons Inc., Patrick Sook and Asbury Carbons Inc. Employee Stock Ownership Plan alleges that ESOP fiduciaries allowed Asbury Carbons, a family-owned company, to be sold to a hedge fund for much less than it was worth. The ESOP owned a significant portion of company stock, and as a result of the sale, ESOP participants lost more than half the value of their retirement savings.
Glove Maker Forced Labor Lawsuit Not OverSanta Clara, CA A California federal judge last month said he won’t dismiss a Smart Glove Holdings forced labor lawsuit filed by AirBoss until he has more information to bring before a California court. The Malaysian glove maker is trying to have the $68 million California labor lawsuit tossed.
