Sacramento, CA Last year nearly 19,000 workers filed claims with the state of California for at least $338 million in lost or stolen wages alleging wage theft by their employers. But the Golden State consistently breaks its own law by not meeting deadlines for resolving cases. The Labor Commissioner’s office has provided data that shows many California lost wages claims take three times longer than the legal minimum of 135 days to resolve.

Gaming Giant to Settle ERISA Lawsuit for $5.5 Million
St Joseph, MO On January 30, the federal district court for the Western District of Missouri gave preliminary approval to a $5.5 million settlement that will end Lipari-Williams v. Penn National Gaming, Inc. In their class action ERISA lawsuit, casino workers claimed that the company reduced their paychecks if they used tobacco in violation of ERISA, the Fair Labor Standards Act (FLSA), Missouri minimum wage laws and the Affordable Care Act (ACA). Settlement amounts will vary, but members of the ERISA class are expected to pocket roughly $370 each. Final approval of the unopposed settlement offer is expected in May.

Santa Clara, CA  A federal judge in the 3M defective earplugs MDL is not buying into 3M’s interpretation of medical testing records recently produced by the Department of Defense. 3M hired an economic consulting firm to analyze the DOD data to ensure the company a positive outcome, rather like insurance companies hiring their own medical experts to deny disability benefits.
