San Francisco, CA San Francisco officials see the $5.325 million DoorDash settlement as a victory --and it’s the largest amount ever recouped-- after an investigation found that the food delivery company misclassified California workers, used customer tips to subsisize workers’ base pay, and failed to provide workers both sick leave and health care coverage.

Los Angeles, CA On October 18, a showrunner moved in Los Angeles federal court for class certification of a group of TV writers who claim that they were cheated of residual payments owed by streaming services. They claim that their union failed to represent their interests adequately in negotiating a secret lump sum settlement. Although royalties and other residual payment can make up a big portion of the income that TV writers and other creatives make, these payments are not technically “wages” covered under the provisions of the California Labor Code.

Columbus, OH Antonio Tomaro brought an employment discrimination lawsuit against J.P. Morgan Chase Bank, his former employer, claiming that he was terminated because he was gay. Tomaro v. J.P. Morgan Chase Bank N.A. is not an unpaid wages claim, but an employment discrimination lawsuit under Title VII of the Civil Rights Act of 1964 and Ohio state law.

San Francisco, CA  On November 15, California Attorney General Rob Bonta announced that Amazon had agreed to pay the State of California $500,000 and amend its Covid-19 notification practices to comply with California’s new “right-to-know” law. AB 685, enacted in December 2020, amended the California Labor Code to require employers to notify workers about potential workplace exposure in ways designed to actually provide them with meaningful information, on the basis of which they might make informed healthcare choices.
