Bard to Pay $500,000 in Third Bellwether Trial
Santa Clara, CA In the third hernia mesh bellwether trial in multidistrict litigation, C.R. Bard and Davol Inc. were ordered by a federal jury to pay $500,00 to a Maine man who claimed his hernia mesh caused pain and other complications. The jurors found the company liable for failure to warn, strict liability, and negligence but Bard was off the hook for any punitive damages.

Jury Awards $107 Million in Asbestos Mesothelioma Lawsuit
Los Angeles, CA On July 11, a California jury awarded the family of a man who died of asbestos mesothelioma more than $107 million. Joel Hernandezcueva, the father of four young children, died in 2014 from pleural mesothelioma, a terminal cancer that his treating physicians testified is caused only by asbestos exposure.

Amazon Facing California Wage and Hour Proposed Class Action
Santa Clara, CA A proposed class action filed in California federal court on behalf of Amazon warehouse managers accuses Amazon of violating California labor laws, including failure to pay overtime, not providing adequate meal and rest breaks, and failure to keep accurate payroll records. And this isn’t the first Amazon overtime lawsuit.

National Collegiate Athletic Association Class Action Lawsuit Going Forward
Santa Clara, CA A California federal judge has given the green light for labor lawsuits accusing the National Collegiate Athletic Association (NCAA) of depriving U.S. college athletes of compensation for the commercial use of their “name, image and likeness” to proceed as an anti-trust class action. The plaintiffs, three college athletes, have accused the NCAA and its conferences of conspiring to restrict payments to athletes for television broadcasts, video games and other revenue sources.
