Das neue EU-Datenschutzrecht entfaltet seine Wirkung ab dem 25. Mai 2018. Es führt neben erweiterten Dokumentations- und Meldepflichten für Datenverarbeiter auch drakonische Bussgelder in der Höhe von bis zu 4% des jährlich erzielten, weltweiten Konzernumsatzes bzw. maximal 20 Mio. EUR ein. Nachfolgend wird dargelegt, welche Auswirkungen das neue EU Recht für Schweizer Unternehmen hat.

Dear Customers and Business Partners,

 

The new EU Data Protection Regulation will take effect on 25 May 2018. Alongside enhanced documentation and reporting requirements for data processers, it also imposes draconian fines of up to 4% of the total worldwide annual turnover of groups, subject to a maximum of EUR 20 million. This article presents the implications of the new EU legislation for Swiss enterprises.

Le nouveau droit européen de la protection des données prendra effet à partir du 25 mai 2018. Outre des obligations de documentation et de notification étendues pour les personnes traitant des données, ce droit prévoit également des amendes sévères pouvant aller jusqu'à 4% du chiffre d'affaires annuel mondial réalisé par le groupe, mais jusqu'à 20 millions d'euros au maximum. Les répercussions qu'aura le nouveau droit de l'UE sur les entreprises suisses sont exposées ci-après.
