Im Arbeitsrecht erscheint die Schweizer Rechtsordnung recht liberal, insbesondere was das Arbeitsverhältnis zwischen den Parteien anbelangt, das hauptsächlich auf dem Grundsatz der Vertragsfreiheit basiert. Bei der Rekrutierung, der Einstellung oder der Entsendung von Mitarbeitenden in die Schweiz sind jedoch einige Punkte zu beachten, von denen wir einzelne erläutern möchten.

In labour law, the Swiss legal system appears to be quite liberal, most particularly as regards the employment relationship between the parties which is mainly governed by the principle of contractual freedom. Some issues shall however be borne in mind when recruiting people, having employees or seconding employees to Switzerland and we would like to outline some of them.

En matière de droit du travail, l'ordre juridique suisse paraît plutôt libéral. C'est particulièrement le cas en ce qui concerne la relation de travail entre les parties, principalement régie par le principe de liberté contractuelle. Il sied toutefois de garder à l'esprit certains éléments qui peuvent être délicats dans le cadre du recrutement, des rapports avec les employés ou de détachement de travailleurs en Suisse.
