You Now Have Five Years to Make Portability Election

When a farmer passes away with unused lifetime exemption remaining, most of the time, the surviving spouse should consider filing a Form 706 to elect portability. The election "ports" the remaining exemption amount over to the surviving spouse. The IRS just issued guidance allowing five years to make a portability election.
