Shorter Trial Scheme Pilot On 1 January 2024, a pilot scheme capping costs for patent cases in the Shorter Trial Scheme within the Business and Property Courts was launched. The pilot introduces a cap of 500,000 on the final determination of a claim in relation to liability and a cap of 250,000 on an inquiry as to damages or account of profits. The trial will run until 31 December 2026, unless it is extended or modified. The cap aims to improve access to the Patents Court by reducing costs for cases which are less complex and less valuable, but for which the Intellectual Property Enterprise Court is not appropriate. |
