US Court of Appeals for the Eleventh Circuit Opinions | Sabal Trail Transmission, LLC v. 3.921 Acres of Land in Lake County Florida | Docket: 18-11836 Opinion Date: January 22, 2020 Judge: Jill Pryor Areas of Law: Energy, Oil & Gas Law, Real Estate & Property Law | Sabal Trail brought a condemnation action to acquire permanent and temporary easements that would allow it to build and operate a portion of the pipeline on property owned by Sunderman Groves. The jury awarded Sunderman Groves $309,500 as compensation for the easements, and the district court entered a final judgment providing that as part of the compensation award, Sunderman Groves was entitled to recover its attorney's fees and costs in an amount to be set by the court. The Eleventh Circuit held that the district court did not abuse its discretion in allowing Sunderman Groves to testify about the value of the property and the court lacked jurisdiction to review whether Sunderman Groves was entitled to attorney's fees and costs. Accordingly, the court affirmed in part and dismissed in part. | |
