#1 Last-Ditch Effort for 3M Bair Hugger AppealSanta Clara, CA 3M has asked the U.S. Supreme Court to grant a review of the U.S. appeals court decision to reinstate close to 6,000 Bair Hugger lawsuits claiming the warming blanket used in surgery results in knee and hip infections. In August 2021, the US Court of Appeals for the Eighth Circuit revived the lawsuits.
#2 Microsoft to Pay $2 Million in Workplace Bullying CaseAustin, TXMichael Mercieca kept the faith and after seven years finally saw the courts order Microsoft to pay for bullying him to a near breaking point.
#3 Maker Of “Neuro” Drinks Agrees To Pay $500,000 In Fines and Restitution Neurobrands LLC, the Santa Monica-based maker of the “Neuro” line of drinks, has agreed to a permanent court injunction that requires it to change its marketing practices. The company will also pay $500,000 in penalties and restitution as part of a settlement with local prosecutors.
#4 Zetia and/or Statins: The Good, the Bad and the UglyHalle-Wittenberg, Germany Can a drug designed to curb heart attacks also cause heart attacks in some people? Apparently, it's possible with statins or medication like Zetia when used in combination with a statin. Statins are designed to lower the "bad" cholesterol thought to be a contributing factor for heart attack and stroke, while leaving the so-called "good" cholesterol to do the good work that good cholesterol, ultimately, does.

#7 DOJ says No-Poach Agreements IllegalLos Angeles, CA Weighing in on a California labor lawsuit filed by truckers against trucking companies, the U.S. Department of Justice (DOJ) said that competing employers’ no-poach agreements are inherently illegal.
#8 Dell found Liable for Transgender DiscriminationNew York, NY An arbitrator found that Dell Technologies discriminated against 61-year-old Cicilia Gilbert, a transgender employee by firing her during her gender transition, said Gilbert’s labor law attorney. According to Cicilia Gilbert’s lawsuit, the tech giant terminated her in the middle of her transition and a co-worker advised her not to come out of the closet.
#9 Texas Employment Law: Don't Wait to Take Your PTOHouston, TX Pete did his company a service by not taking Paid Time Off (PTO) in over four years of employment. Yesterday was his last day of work. He has accrued 150 hours of PTO, but Texas Employment law does not require that employers pay workers for earned but unused vacation upon termination, unless the employer has a written policy or past practice of doing so.
#10 Equinox Employees Go Ahead with Three Class ActionsLos Angeles, CA Over 9,000 Equinox employees, including personal trainers and group fitness instructors, have been given the green light by a California federal judge to have their wage claims and other California labor laws resolved by three class actions rather than individually.
