#1  Delta Slammed with Lawsuit over Personal Cellphone Use
Los Angeles, CA - Delta Air Lines employees required to use their personal cell phones and computers for work-related tasks without being reimbursed is a California labor law violation, according to a PAGA complaint filed by an aggrieved employee.

#2  3M Sending Payments for Faulty Combat Earplugs
Santa Clara, CA - As part of its $6 billion faulty combat earplug settlement, 3M began sending payments last month to military veterans who suffered hearing loss and other significant injuries. The payments will resolve about 300,000 lawsuits claiming the manufacturing company knowingly sold defective earplugs that caused hearing loss and tinnitus. Those affected are mainly US military who were in training and combat from 2003 to 2015.

#3  Nurses Filed Unpaid Wages Lawsuit Against U.S. Nursing Corp
Denver, CO - Two nurses last month filed a proposed class action against U.S. Nursing Corp, claiming they were underpaid while filling in for workers on strike at Kaiser Permanente South Bay Medical Center last October. And it’s not the first class action facing U.S. Nursing.

#4  Take the Super out of El Super
Los Angeles, CA - Not once but twice has the California Labor Commissioner’s Office fined Bodega Latina (doing business as El Super) grocery stores for not providing or delaying supplemental paid sick leave or other benefits to 240 workers affected by COVID-19. In July Bodega Latina was fined $447,876 for similar California labor violations that affected 95 grocery store employees. Being fined twice begs the question: will conscientious consumers boycott El Super?

#5  Another Monsanto Roundup Loss for Bayer
Philadelphia, PA - A Pennsylvania man was awarded a massive $2.25 billion after a Pennsylvania jury unanimously ruled that Bayer’s Roundup caused his non-Hodgkins lymphoma. The jury’s verdict on January 26 included $2 billion in punitive damages and jury members determined that Monsanto was negligent in warning customers about the dangers of its weedkiller. That amount is believed to be one of the biggest payouts ever to an individual for company negligence.

#6  Weight Loss Drugmakers Face Stomach Paralysis Lawsuits
Santa Clara, CA - A drugmaker’s dream is a patient continuing treatment and forever refilling prescriptions--and that spells profit.  Such is the case with the weight loss drugs because discontinuing them leads to regaining lost weight. Ozempic, Mounjaro and Wegovy are star performers, but a drugmaker’s nightmare is the serious side effects that leads to lawsuits, particularly when the manufacturers failed to disclose potential long-term impacts of serious injuries such as gastroparesis.

#7  Seroquel Side Effects for the Elderly
Pearblossom, CA - Seroquel is a neuroleptic indicated for the treatment of bipolar disorder—and like most drugs carries a host of Seroquel side effects, including diabetes, tardive dyskinesia and even birth defects. However, there is a little-known use for Seroquel off-label that concerned the daughter of one Alzheimer's patient for whom she was caring.

#8  $155 Million Overtime Settlement Approved for Prison Supervisors
San Francisco, CA - A $155 million overtime settlement filed by current and retired California prison supervisors has been approved by a San Francisco Superior Court Judge. The original California labor lawsuit, dating back to 2008, alleged unpaid overtime wages for tasks performed before and after their shifts.

#9  Delta Settles Overtime Lawsuit for $3.5 Million
Los Angeles, CA - Delta Air Lines has agreed to pay $3.5 million to a class of approximately 3,300 past and present Delta workers to settle claims that the airline failed to pay overtime as required under the provisions of California labor law. The dispute centered on a complicated pay formula that included shift differential pay, non-discretionary bonuses, profit-sharing payments, and the fair market value of employee travel passes.

#10  da Vinci Robot Allegedly Marketed to Less-Skilled Doctors
Sunnyvale, CA - As the first da Vinci lawsuit gets underway, one witness has testified in the da Vinci robot lawsuit that the surgical device was marketed specifically to surgeons that were identified by the device’s maker as being less skilled. Meanwhile, the US Food and Drug Administration (FDA) is reportedly investigating problems with the da Vinci robot.
