#1  Red Lobster Workers Seeing Red
Baltimore, MD - A Red Lobster employee has filed a proposed wage and hour class action in federal court accusing the seafood chain of violating the Fair Labor Standards Act (FLSA) and Maryland Wage and Hour Law. The plaintiff claims the company has not been paying its tipped employees all their wages owed. Rather, workers are paid less than minimum wage with the expectation that tips will make up the difference.

#2  Mandalorian Actress Beats Back Disney Bid to Toss Wage Lawsuit
Los Angeles, CA -  On July 24, the District Court for the Central District of California denied The Walt Disney Company’s motion to dismiss actress Gina Carano’s wrongful termination and sex discrimination lawsuit. Carano’s California employment lawsuit alleged that Disney had violated California law by firing her in retaliation for various social media posts that the company found objectionable. Gina Carano v. The Walt Disney Company will now, presumably, move toward trial. For legal nerds, the lawsuit raises some interesting issues about balancing the employers’ and employees’ First Amendment freedom of speech rights.

#3  Bayer Hopeful Farm Bill will End Roundup Lawsuits
Santa Clara, CA - Bayer has aggressively lobbied the upcoming Farm Bill, which Congress has to adopt every five years to sustain federal agriculture and nutrition programs. The ag chemical giant is counting on the provision that would result in only EPA-approved labels on pesticide packaging, such as Monsanto Roundup – amounting to a “Get out of jail free” card for pesticide companies, says one victims’ rights representative.

Santa Clara, CA - The Suboxone maker had a busy month facing more tooth decay lawsuits, including a Canadian class action.

Brooklyn, NY - As of May 2024, the trial dates for four bellwether trials in the U.S. District Court, Eastern District of New York multidistrict Exactech litigation (MDL) have been set as follows:

#6  Cathay Pacific Pilots Flying High in California with $16.65M Settlement
Los Angeles, CA - Airline workers in California are likely flying high with news that Cathay Pacific pilots will receive $16.65M to resolve a wage and hour class action lawsuit filed back in 2017. The pilots claimed the airline violated California’s labor laws relating to meal and rest periods, overtime and reserve duty pay – in some instances they weren’t even paid minimum wage. The settlement, however, tallies up to about three times as much as Cathay’s prior offer.

#7  State AGs Nail $86 Million Suboxone Settlement
New York, NY -  On July 26, New York Attorney General, Letitia James announced that Suboxone manufacturer Indivior had agreed in principle to pay $86 million to settle Suboxone lawsuits brought by the attorneys general of New York, Illinois, Tennessee, Utah and Virginia. The settlement was reached in coordination with 11 other states. Their dangerous drug lawsuits alleged that Indivior produced and then marketed buprenorphine-based products to dangerous prescribers who, under the guise of “medical treatment,” triggered further harm.

#8  SpaceX v NLRB Lawsuit Currently Stays in Texas
Santa Clara, CA - A 5th U.S. Circuit Court of Appeals on August 9th overturned—for now—a Texas federal judge’s decision that would have landed one of the rocket maker’s constitutional lawsuits against the National Labor Relations Board in California.

#9  Popular Diabetes/Weight Loss Drugs Linked to Rare Form of Blindness
Philadelphia, PA - In February, the rapidly growing number of Ozempic side effect lawsuits was consolidated for pre-trial proceedings in the Eastern District of Pennsylvania. Multidistrict Litigation (MDL) 3094 was stalled at first, but the early steps are finally underway.   

#10  California Judge Approves Old Dominion Freight Line and Dockworkers Settlement
Santa Clara, CA - A California federal judge has given the green light to settle a California dockworkers lawsuit accusing Old Dominion Freight Line Inc. of failing to provide meal and rest breaks. And Old Dominion seems to have developed a habit of California labor overtime violations.
