Just how serious is the SEC getting about fintech? We already know the regulator is looking to update policies with its request for public comment. But this week, a number of SEC commissioners and chairman Gary Gensler made fintech a primary concern in remarks made during the Practicing Law Institute’s SEC Speaks conference.

Gurbir Grewel, director of the SEC’s enforcement division, celebrated the agency’s first enforcement actions made against cryptocurrency trading platforms, digital asset fraud and crowdfunding apps. Commissioner Caroline Crenshaw gave an entire speech about digital assets and how SEC is trying to balance supporting innovation while protecting investors. And Gensler once again spoke about his concerns with predictive analytics and how both startups and traditional financial institutions are using algorithms to hyper-target product marketing and optimize their revenue streams.

The explosion of digital financial technology — in wealth management and investing as well as areas like peer-to-peer lending, payments and insurance — has been one of the stories of the last decade, but big changes in the regulatory landscape are coming soon.

Is the industry in need of newer, or at least clearer rules governing fintech? Or will regulators put an end to an era of unprecedented innovation?
