Amarillo, TX On September 21, US District Court for the Northern District of Texas Judge Matthew J. Kasmaryk held that plan fiduciaries may consider environmental, social and governance (ESG) factors in choosing pension plan investments. The ERISA lawsuit, Utah v. Walsh, was seen as the “anti-woke” coalition’s best shot at limiting the range of factors that fiduciaries could consider in investment decisions.

Many women are just now learning that they have rubbed carcinogenic formaldehyde into their scalps for decades and thousands of hair relaxer lawsuits have been filed – and continue to be filed – by women of color against these companies, including L’Oreal and Revlon.

Macon, GA A proposed, nationwide collective of Geico’s call center-based sales workers dating to October 2020 claims the insurer required its sales representatives to work several minutes daily before and after their regular shift without pay. The Geico overtime lawsuit demands all unpaid overtime wages accrued during the untracked time, plus liquidated damages. Another lawsuit filed earlier this year accuses Geico of misclassification to avoid workers’ benefits and overtime and in 2022 class action status was granted in a former claim adjuster’s lawsuit accusing GEICO of violating federal and state overtime laws.

Santa Clara, CA After serious injuries have been linked to Bard PowerPort catheters, many PowerPort lawsuits have been filed. The Dickey Anderson law firm alone has filed dozens of complaints, which could be the tip of the iceberg: The FDA has received thousands of reports from patients claiming injuries or side effects from the Bard catheters. “Most of our clients have developed infection from this defective port-catheter and one woman had to undergo surgery to remove the implanted device,” says attorney Aaron Dickey. “Another client had a cardiac injury that we believe was attributed to Bard’s catheter. These injuries shouldn’t have happened because the science was there to make a safer alternative.”

Pensacola, FL A group of 3M’s Aearo Technologies’ attorneys have taken issue with the U.S. Trustee’s objection to their motion seeking more than $7 million in fees in the 3M combat arms earplug lawsuit settlement of more than $6 billion. Without their "substantial contribution" to the dismissal of the Aearo bankruptcy case, the attorneys said in an Indiana bankruptcy court, 3M would never have reached a settlement for about 240,000 people who filed defective earplug complaints. And wouldn’t you know it – on the heels of this settlement comes an identity theft scam targeting veterans.
