Goed nieuws leek het, totdat Pols en Engel na afloop van de zitting van hun advocaten begrepen wat dat betekende. Tot duidelijk wordt wat het uiteindelijke bedrag van de inkomstenbelasting is, moeten ze een bedrag in een depot veiligstellen, bij wijze van betalingsgarantie. Daarmee zouden de beslagleggingen door de overheid op hun panden echter niet worden opgeheven en het onroerend goed portfolio nog altijd onverkoopbaar blijven. In feite waren ze dus vrijwel terug bij af. Wat als een onoverkomelijk ‘dispuut’ met de Duitse belastingdienst voor de rechter was gebracht om uitsluitsel te verkrijgen, was door de rechter in een ommezien, weliswaar in beperkte vorm, weer bij de partijen gelegd. Twee uren waren voor de zitting gereserveerd. Dat het nauwelijks meer dan een uur duurde, kwam alleen omdat het verlaat begon. Men had de Nederlanders verzuimd te informeren dat de locatie dit maal niet de buiten de stad gelegen gerechtshangar was. Advocaat Carlos Freidl had de Nederlanders in allerijl alsnog naar het juiste adres, het historische Landsgericht in de oude binnenstad van Bremen, geloodst. Tijdens de eerste zitting was overeengekomen, dat niet de hele, door partijen aangeleverde, dossiers zouden worden besproken. De rechters wilden zich in eerste instantie beperken tot het ontleden van de door het ‘Finanzamt’ ingediende belastingvorderingen, omdat ze daar meteen al grote vraagtekens bij zetten. Door ziekte van de openbare aanklager, de heer Mosch, ging dat ‘ontleden’ toen niet door en werd het doorgeschoven naar deze, tweede, zitting. Mosch bleek donderdagochtend hersteld. Ook bleek dat de bespreking van de belastingvorderingen onderling al min of meer had plaatsgevonden, kennelijk zonder medeweten van Engel en Pols. Rechter Prange scheen Mosch en de advocaten in ieder geval al duidelijk gemaakt te hebben dat de eis met terugwerkende kracht omzet- en bedrijfsbelasting te heffen niet opging. Het zou dus “alleen nog” om de opgevoerde inkomstenbelasting gaan. Daarmee bleek in één pennenstreek meer dan driekwart van het zogenaamde ‘fraudebedrag’ te zijn weggestreept. Een heuglijke uitkomst, ware het niet dat Engel en Pols gedurende de afgelopen vier jaar, vanwege deze zaak, bespied, zwaar geïntimideerd en financieel geruïneerd zijn. De vanzelfsprekendheid waarmee de bulk van de eis ontoelaatbaar verklaard werd, maakte het even verlichtend als pijnlijk. De opvallend jong ogende Mosch, ietwat verloren in zijn eentje tegenover een team van rechters rechts van hem en Pols en Engel plus advocaten tegenover, antwoordde dat hij zich weliswaar in de gereduceerde eis kon vinden, maar dat hij het nog niet intern besproken had. Prange benadrukte dat er aardig wat rammelde aan zijn onderbouwing van de omzets- en bedrijfsbelastingseis, implicerend dat een interne bespreking daar weinig aan kon veranderen. Partijen hadden volgens hem de keuze: óf het met elkaar eens worden over de depot-optie aangaande de inkomstenbelasting, óf de zaak in zijn geheel behandelen – wat twee jaar zou kunnen duren en waarbij de eerste zitting waarschijnlijk pas halverwege 2024 plaats zou vinden. De zaak zou dan bovendien voor een andere ‘Kammer’, vallend onder de belastingrechtspraak, komen, compleet met nieuwe rechters. Of die Engel en Pols even goed gezind zullen zijn, is de vraag. Prange drong er daarom bij beide partijen op aan om “vernünftig” te onderhandelen. En snel ook, want hij gaat dit jaar nog met pensioen. Advocaten Freidl en Domanski wierpen nog tegen dat de argumenten voor de zogenaamd te betalen inkomstenbelasting ook door het Finanzamt uit de losse pols geschud zijn en de betaling ervan dus niet vanzelfsprekend. De rechter vroeg beide partijen niet te verharden, maar bleef bij zijn besluit: óf nu een oplossing, óf twee jaar lang de dossiers geheel doorploegen, met alle risico’s van dien. Volkomen buiten de context vroeg de rechter ineens naar de persoonlijke situatie van de Nederlanders en leek hij vooral te willen weten of Jan en Jeroen nog contact hadden met hun kinderen. Met de informatie werd verder niets gedaan. De opmerking van Jan dat zijn relatie stuk ging vanwege deze zaak, en met name vanwege de gewelddadige inval door een overmacht aan politieagenten, werd genegeerd. De rechter sloot de zitting in de hoop dat partijen er vóór 28 november uit zouden komen. Tijdens de nabespreking in de gang probeerden de twee advocaten hun cliënten te overtuigen van de redelijkheid van het voorstel. Als Pols en Engel nou gewoon maar een borgsom voor de nog te berekenen inkomstenbelasting (een paar ton!) zouden overmaken, dan kunnen ze gaan en staan waar ze willen, want er is geen sprake meer van een strafrechtelijke vervolging. De advocaten hadden er alleen geen rekening mee gehouden dat door de jarenlange tegenwerking, invallen en beslagleggingen er eenvoudigweg geen geld meer beschikbaar is om de zekerstelling te realiseren – zelfs al zouden Pols en Engel daarmee instemmen. (Dat deden ze vooralsnog niet, want de eis was huns inziens niet alleen ongeldig, maar de berekening mede gebaseerd op het inmiddels weggevaagde deel van de eis en daardoor ook nul). Dat depotgeld zou er eventueel wel zijn, als Engel en Pols de panden zouden kunnen verkopen, maar door de beslaglegging is dat onmogelijk. Die beslaglegging zou overigens ook niet opgeheven worden door de depotbetaling. Daarvoor moet weer een ander traject belopen worden. Duidelijk werd, dat de rechtszaal te vroeg verlaten was. Het geschil dat een doolhof werd en waar een rechter uitkomst moest bieden, is nu weer een doolhof waarin beide partijen zelf een uitweg moeten vinden. Beide advocaten beraden zich opnieuw, ter voorbereiding van de laatste zitting, die van 28 november. |
