Good Tuesday afternoon. Tonight Andrea Mitchell has a one-on-one interview with Dr. Anthony Fauci, and the Supreme Court appears unlikely to strike down Obamacare. |

Here is what’s in our Nightly Rundown. |

Fauci says vaccine should be available for emergency use in December |
---|
|
---|
Dr. Anthony Fauci, the nation’s leading infectious disease expert, told Andrea Mitchell that “help is on the way,” following the announcement by Pfizer on Monday that its experimental vaccine was more than 90 percent effective in early data. |
---|
|
---|
Fauci said he expects the vaccine to go through the FDA’s emergency use authorization process in the next week to week and a half. |
---|
|
---|
If the vaccine gets that authorization, Fauci said that “by the time we get into December, we’ll be able to have doses available for people who are judged to be at the highest priority to get it first.” |
---|
|
---|
HHS Secretary Alex Azar told NBC News that there should be enough vaccine “by the end of March to early April” to have general vaccination programs for all Americans. |
---|
|
---|
Fauci also suggested the guidance on masks may be changing. |
---|
|
---|
For months now, health officials have been urging Americans to wear masks to prevent the spread of Covid-19 to others. |
---|
|
---|
Now Fauci says that new data shows that masks can protect the wearer as well. |
---|
|
---|
“Recent studies have shown it’s both ways,” Fauci told Andrea Mitchell today. “It’s a two-way street. You protect others, their mask protects you, and your mask also protects you.” |
---|
|
---|
The U.S. has surpassed 10.2 million cases of coronavirus, and more than 240,000 deaths, according to the latest NBC News tally. |

Supreme Court signals willingness to uphold Obamacare |
---|
|
---|
The Affordable Care Act, former President Barack Obama’s signature health care legislature, appears likely to survive its third challenge before the Supreme Court. |
---|
|
---|
The court’s three liberal justices seemed prepared to uphold the law, and two conservatives, John Roberts and Brett Kavanaugh, signaled they were not likely to strike down the law in its entirety. |
---|
|
---|
That would create at least a five-vote majority to keep Obamacare. |
---|
|
---|
Both Roberts and Kavanaugh, a Trump appointee, suggested the individual mandate might be subject to severability — leaving the rest of Obamacare intact. |
---|
|
---|
The individual mandate is a provision that requires Americans to buy insurance, or pay a penalty — but the Republican-controlled Congress reduced the penalty to $0 in 2017. |

Biden says Trump’s refusal to concede is an “embarrassment” |
---|
|
---|
President-elect Joe Biden said this afternoon that the transition of power is “well underway,” as he called out President Trump for his refusal to concede. |
---|
|
---|
“We’re already beginning the transition,” Biden said. “We’re well underway, and the ability for the administration in any way, by failing to recognize our win, does not change the dynamic at all.” |
---|
|
---|
“The fact that they’re not willing to acknowledge we won at this point is not of much consequence in our planning and what we’re able to do between now and January 20th.” |

Defiant Trump tweets “WE WILL WIN!” as legal challenges move forward |
---|
|
---|
Some of President Trump’s aides are worried that his refusal to concede could cause damage to himself, and to the Republican party. |
---|
|
---|
Trump also made multiple, unsubstantiated claims about “ballot counting abuse,” despite a lack of evidence to support his accusations. |
---|
|
---|
The tweets come a day after Attorney General William Barr authorized federal prosecutors to investigated claims of voter fraud “if there are clear and apparently-credible allegations of irregularities that, if true, could potentially impact the outcome of a federal election in an individual State. |
---|
|
---|
After Barr gave that order, the head of the Justice Department branch that prosecutes election crimes resigned in protest. |
---|
|
---|
Richard Pilger said in an email to colleagues that he could no longer do his job in the wake of Barr’s memo. |
---|
|
---|
A number of top Republicans, including Mitch McConnell, have backed the president’s refusal to admit defeat. |
---|
|
---|
Secretary of State Mike Pompeo told reporters today, “There will be a smooth transition to a second Trump administration,” — though he may have been joking. |
---|
|
---|
Emily Murphy, a Trump appointee, has not signed a letter of “ascertainment,” which would acknowledge Biden’s win and unlock millions of dollars in transition funding. |

Vatican report finds popes knew of allegations against ex-cardinal |
---|
|
---|
Popes Benedict XVI and John Paul II were aware of sexual misconduct allegations against American Cardinal Theodore McCarrick, a new report from the Vatican has found. |
---|
|
---|
The 449-page report found that John Paul II, in particular, was warned about McCarrick, but still named him archbishop of Washington, after believing McCarrick’s denials. |
---|
|
---|
McCarrick was defrocked in 2019 by Pope Francis after an investigation found sex abuse allegations against him were credible. |
---|
|
---|
The report says it wasn’t until 2017 that Francis was given evidence of McCarrick’s misconduct. Francis has consistently denied knowledge of McCarrick's sexual misconduct. |
