Note from the instructor: Overview of Laws Related to Fraud and Overpayments

This week’s note from the instructor is written by written by Judith L. Kares, JD, regulatory specialist for HCPro.

In this week’s note, I will provide a broad overview of those other relevant federal statutes and regulatory schemes and focus on the Overpayments rule and its underlying statute at a later date. I will begin, however, with the definition of “overpayments” included in the Overpayments rule. Under the Overpayments rule, an “overpayment” means any funds that a “person” has received or retained under Medicare to which the “person”, after applicable reconciliation, is not entitled. Under the rule, a “person” means a provider or supplier furnishing services under original Medicare (Parts A and B).
