The Wake Up

FRIDAY, OCT. 21, 2022

In 2019, my family bought our first-ever Cedar Point Gold Passes, good for the 2020 season. Of course, the 2020 season was shortened by the COVID-19 pandemic, so America’s Roller Coast extended our passes by a year.

We got three seasons of rides, parades and water slides, which was more than enough for me. But one angry passholder sued over the issue, all the way to the state’s highest court.

Cedar Point passes: The Ohio Supreme Court ruled Thursday that Cedar Point does not have to refund money to season passholders who were unhappy with how the park handled the pandemic-shortened season in 2020. Susan Glaser reports the unanimous court ruled the park had the right to adjust operating dates and hours without issuing refunds, denying the claim of a Mayfield Heights season passholder who sued the park two years ago, alleging a breach of contract.

Judge ratings: A collection of local legal organizations hopes Cuyahoga County voters in the Nov. 8 general election turn to Judge4Yourself.com to find out what lawyers who actually practice in court think of candidates running for judges. The legal groups rated two of three Democratic challengers to the Ohio Supreme Court above the Republican candidates. In six of seven races for Common Pleas judge, the groups gave higher scores to incumbents than their challengers, Cory Shaffer reports.

Today in Ohio: Motorists along Interstate 271 watched aerial linemen recently perform “proactive maintenance” for FirstEnergy. We’re talking about those acrobatics, as well as the childhood home of “King of Porn” Reuben Sturman in Cleveland Heights on Today in Ohio, cleveland.com’s daily half-hour news podcast.

Statehouse and Politics

Legislature races: All 99 state House seats and 17 of 33 Senate seats are up for grabs on Election Day. Together, they control a $74 billion state budget and write Ohio’s rules for guns, abortion access, schools, sports betting, and a range of other issues, reports Jake Zuckerman. With Republicans’ current dominance, new district lines they drew to their favor, and a towering campaign cash advantage, the party is all but certain to keep control of both chambers of the general assembly.

Election accusations: Ohio Auditor Keith Faber told members of the Westerville Tea Party that it was unlikely that widespread fraud occurs in Ohio elections. But that didn’t stop him speculating that the Cuyahoga County Board of Elections could divert special voting-machine paper to other states where unscrupulous elements might use them to produce fraudulent ballots, reports the Ohio Capitol Journal.

Northeast Ohio News

Wade Oval: The Cleveland Botanical Garden is not in violation of a 140-year-old deed that created Wade Park when it built an underground parking garage, began charging admission and regulated the hours that the space is open, the Ohio Supreme Court ruled Thursday. Laura Hancock reports the court unanimously agreed that city of Cleveland, the botanical garden and University Circle are complying with terms set by industrialist Jeptha Wade when he donated 73 acres to the city in 1882.

Business and Healthcare

Weekly cases: After dropping for two weeks running, the weekly number of COVID-19 cases in Ohio rebounded this week, from 8,535 last week to 11,097 this week, reports Julie Washington.

Flu season: Expect a tougher flu season this year — with a peak that comes earlier than the typical February crescendo and an estimated 40 flu-related deaths in Cuyahoga County. Julie Washington reports that’s because kids are back in school, masks are rarely worn in public and no one is planning a socially distanced Thanksgiving dinner.

Largest hotel: Ohio has a new largest hotel and it’s open for business just north of downtown Columbus. Susan Glaser reports that the newly expanded Hilton Columbus Hotel now has 1,000 rooms on either side of High Street, connected to the Greater Columbus Convention Center in the city’s Short North neighborhood.

Crime and Courts

Officer resigns: Former Cleveland police officer Hassan Ali was awarded for his heroism for helping safely find a kidnapped baby. Months later, reports John Tucker, he resigned from the Cleveland Division of Police, having been accused of blackmailing a woman in an attempt to force her to have an abortion and then lying about it.

Barbershop shooting: Five people were shot Thursday afternoon at a barbershop on State Road in Cleveland, Molly Walsh reports. Police say a man entered IFIXUGLY barber shop on State Road at about 3 p.m. and began firing rounds at people inside. Four men, ranging from 19 to 34 years old, and a 29-year-old woman were shot and transported to MetroHealth Medical Center. One man is in critical condition.

Arts & Entertainment

Christmas Ale: Great Lakes Brewing Co.’s annual first pour party unofficially kicked off the holiday season in Cleveland, complete with the festive, seasonal launch of Christmas Ale. Marc Bona reports the spicy brew officially was released to the masses Thursday morning as brewery founders Dan and Pat Conway mingled with the crowd.

Garden holiday: The Cleveland Botanical Garden is launching a new holiday décor program – “Twinkle in the 216.” Paris Wolfe reports indoor and outdoor gardens will pay a festive holiday homage to the neighborhood blocks that knit together people, plants and trees.

Things to do: With snow on the grass in some neighborhoods, yard work is ending for the season. That makes more time for entertainment. Paris Wolfe lists "Swan Lake," brunch at the Music Box, the Cavs home opener and 20 more things to do this weekend.
