Raleigh, NC The Eastern District of North Carolina seems poised to approve a $2 million settlement that will end an ERISA lawsuit against Lubbock National Bank as trustee of the TBM Consulting Group, Inc. Employee Stock Ownership Plan. It’s an unfortunately familiar story of a major shareholder/officer who unloads overpriced company stock on employees through an ESOP and then moves on.

California Jury Decision in Zoom Asbestos Trial Admirable
Santa Clara, CA Despite Metalclad Insulation LLC arguing that COVID-19 restrictions and juror irregularities unfairly impacted an asbestos lawsuit claiming the manufacturer was liable for negligently failing to recall or warn about the risks of using insulation containing asbestos, a California jury awarded the plaintiffs, a Navy admiral and his wife, over $2.5 million.

California Court Okays Chipotle Wage Lawsuit Deal
San Francisco, CA On October 2, the Superior Court of California gave preliminary approval to an agreement to settle Turley v. Chipotle Services, LLC., a long-running California labor lawsuit. The workers argued that Chipotle's practice of understaffing caused them to miss meal and rest periods in violation of the California Labor Code. In addition, the Complaint sought penalties under the California Labor Code Private Attorneys General Act.

California Wage Lawsuit Argues Mortgage Company's Pay Practices
Berkeley, CA A former loans officer with Draper and Kramer Mortgage Corporation has filed a California wage lawsuit alleging the company stiffed him and other loan officers out of commissions and other payments, including overtime compensation.
