Weekly Roundup: Legal Considerations

Query key authorities before developing APC scopes of practice

Organizations must enlist and authorize advanced practice clinicians (APC) for practice according to all applicable requirements, their available resources, and their medical staff’s comfort level. Once an organization has decided to move forward with development of an APC authorization process, it’s time to determine appropriate eligibility requirements and parameters for practice within the facility. Each professional group will have different education, training, and certification norms.

Dramatic surge in healthcare cybersecurity breaches since 2015

A KPMG survey shows that 47% of healthcare payers and providers experienced security-related violations or cyber-attacks that compromised data in 2017, yet 87% rated their readiness to defend at four or better on a five-point scale.

Sample contract: Proctoring agreement with third party

When an outside third party is used to proctor, it is always important to describe the parameters of the working relationship in a formal agreement or contract. This agreement must address the expectation that the proctor’s observations and findings will be kept confidential and patient information will not be disclosed.

Tip: Write compliant response letters

Before sending peer review information, a medical staff should first look at state laws to ensure it has a mechanism in place to make disclosures in a confidential manner, says Joanne Hopkins, Esq., an attorney at law based in Austin, Texas.

Cesarean section - Procedure 76

Cesarean section (C-section) is the surgical delivery of a baby through incisions in a woman’s abdomen and uterus. C-sections may be elective, but more often are performed because of potential health risks to the mother or child. A C-section is considered major abdominal surgery and is typically performed by a physician who is board-certified in obstetrics and gynecology (OB/GYN) or by a family physician who has received enhanced training in obstetrics through an extended residency, an obstetrics fellowship, and/or a preceptorship with a physician who has cesarean privileges. Despite lingering inconsistencies regarding the privileging of family medicine physicians for cesarean deliveries, the American Academy of Family Physicians (AAFP) argues that “provision of cesarean delivery by well-trained family physicians augments maternity care services available to women or, in some cases, provides a service that would not otherwise be available.”

Physicians and ED call
Although not a new issue, with changes in lifestyle and practice, increased burnout, and staying in practice at later ages, physicians no longer want to spend one in three nights in the hospital. Medical Staff Briefing talked to medical staff experts to get solutions to filling the ED call schedule.

The 2018 CRC Symposium Case Study Competition and the 2018 CRC Achievement Awards are two application-based contests that showcase excellence in the medical staff services and leadership fields. Winners, who will be selected by a panel of esteemed industry experts, will receive free admission to and recognition at the 2018 CRC Symposium in Las Vegas, Nevada. Read on for more information about the 2018 application process, and click here to learn about last year's winners.

2018 CRC Symposium Case Study Competition

CRC is seeking a pioneering MSP, physician leader, or small team (up to three people) to present a compelling case study at the 2018 CRC Symposium, which will be held in February in Las Vegas, Nevada. Whether you’re a seasoned educator in search of a broader platform to share your expertise or a yet-to-present professional with big ideas, this is the ultimate opportunity.

Any MSP or medical staff leader who is currently involved in credentialing, privileging, peer review, or another important medical staff function is welcome to submit a case study application. The winning proposal will highlight a creative solution that the presenter(s) have helped implement at their organization. By imparting their in-the-trenches experiences and lessons learned, the chosen speaker(s) will shed light on an issue, practice, or principle that affects stakeholders across the modern medical staff landscape.
