Meanwhile, Democrats keep pushing for record turnout to blunt litigation.
• Federal Appeals Courts Jeopardizes Thousands of Minnesota Absentee Ballots (October 30) A federal appeals court ordered postmarked ballots arriving after Election Day be segregated for possible challenge and disqualification of their presidential and vice-presidential votes.
• Supreme Court: Two Swing-State Mail Ballot Return Deadlines Stand, But Ballots Could Still be Rejected (October 28) Conservative Supreme Court justices said it was too late to change the ballot return deadline in Pennsylvania and North Carolina. But they said they'd support disqualifying late-arriving absentee ballots if the issue returned after Election Day.
• Will Supreme Court Election Rulings be 2020’s October Surprise? (October 26) In a Wisconsin ruling, the court's majority sided with a GOP majority legislature that disregarded voters in the pandemic, saying the U.S. Constitution only empowers legislatures to regulate elections with federal candidates—which excludes other courts, state constitutions and statewide officials.
