The Colorado Supreme Court has officially given the green light to energy lawfare. In a 5-2 decision, the state’s High Court last week ruled that Boulder County’s lawsuit against ExxonMobil and Suncor over alleged local harms caused by the effects of climate change is not preempted by federal law. As a result, local officials in Boulder will get to proceed in attempting to use state courts to enforce their preferred policy outcomes on a complex international issue, raising costs on the producers of energy relied on by millions of Coloradans every single day in the process. My co-host Amy Cooke and I were joined by former Colorado Attorney General and US Interior Secretary Gale Norton to discuss Boulder’s claims and those of similar progressive governments filing cases all across the country on a previous episode of PowerGab.
