In early 2022, the Drug Enforcement Administration (DEA) sent a reply letter to an inquiry by Vicente Sederberg’s Shane Pennington, clarifying that cannabis seeds—which contain less than 0.3 percent THC on a dry weight basis—are in fact legal under the 2018 Farm Bill.

The news was considered a surprising yet tepid win for the industry, where licensed growers and breeders have faced difficulties selling and acquiring genetics under stringent regulations in some states, and a “don’t ask, don’t tell” policy in others, while selling seeds to the public for home growing was allowed only under certain state-legal cannabis programs.

The DEA’s letter has therefore created a state-federal disconnect. The legality of non-licensed cannabis growers or breeders selling seeds under state-legal cannabis programs is in question, sowing confusion over whether state or federal law takes precedent here and how to move forward with cannabis genetics under yet another murky regulatory environment.

Join us on Wednesday, Feb. 1, at 2 p.m. ET for a free, 90-minute webinar where we break down the opportunities and challenges surrounding the federally legal cannabis seeds market, with expertise from legal experts and breeders who have jumped in the murky waters (including Brothers Grimm Seeds, which battled with the USPS over confiscated seeds and won, as well as MoneyTree Genetics, which opened a retail storefront selling seeds in Chicago). We’ll also be taking your questions, so don’t miss the opportunity to join us live to better understand one of the most important and complicated industry topics of the year.

Speakers:

  • Shane Pennington, Counsel, Vicente Sederberg LLP
  • Rick Campanella (MrSoul), Original Breeder and CEO, Brothers Grimm Seeds
  • Jay Wexler, Professor of Law, Boston University
  • Tom Wilson, Owner, MoneyTree Genetics
