Workplace health, safety and welfare: legal requirements

There are a number of legal duties which all businesses must comply with on workplace health, safety and welfare.

Manufacturing company fined after worker fatally crushed

The 120,000 fine was issued after a worker was killed when he was trapped between 2 heavy steel beams.

The worker was using an overhead travelling crane to lift the middle of 3 beams to position it better. As it was lifted the 1,800 kg beam rotated in a sling, toppling sideways and trapping him against another beam, causing fatal injuries.

HSE's investigation found the company:

  • failed to ensure a suitable and sufficient risk assessment was carried out by a competent person to identify well known industry standard control measures
  • did not properly plan lifts
  • did not have a system for ensuring that there were adequately qualified supervisors present during lifting operations
