More Long-Term Part Timers May Now Save Through 401k ERISA PlansWashington, DC Beginning on January 1, 2024, an expanded group of long-term part-time employees may be able to participate in their employer’s 401k ERISA retirement plan. It’s a small tweak in the 2019 Setting Every Community Up for Retirement Enhancement Act (SECURE Act) that could have major implications for young and underemployed workers who struggle to save for retirement. Many employers are still processing the changes, so it may ultimately fall to workers to ensure that they are afforded the opportunities provided by law. In most cases, a well-crafted inquiry (with the advice of competent counsel) may eliminate the need for an ERISA lawsuit.
UNITE HERE Dispute with Sky Chefs Back on the PlateLos Angeles, CA UNITE HERE International Union's California labor lawsuit against Sky Chefs Inc. is back on the plate. The Ninth Circuit ruling in December reversed U.S. District Judge Percy Anderson's dismissal in May 2022 of the Union's lawsuit which challenged unilateral wage and benefits changes made by the airline catering company on its employees at Los Angeles International Airport.
Race Bias Lawsuit: Tesla v. EEOCSan Francisco, CA At a San Francisco federal court yesterday, Tesla Inc. said an Equal Employment Opportunity Commission (EEOC) lawsuit claiming widespread race-based harassment at the company’s Fremont, California facility is short on details and, thereford, the lawsuit should be dismissed.
