Appeals court allows "sex-plus-age" claim The 10th US Circuit Court of Appeals ruled in an Oklahoma case involving the Golden Mardi Gras Casino that Title VII of the Civil Rights Act of 1964 permits "sex-plus-age" claims. Title VII holds it is unlawful for an employer to discharge or discriminate against an employee because of race, color, religion, sex or national origin, but it does not have protection for age, which comes under the Age Discrimination in Employment Act. Exempt employees may do nonexempt duties in pandemic The US Department of Labor says the rarity of the coronavirus pandemic means employers can continue to treat those employees exempt under the Fair Labor Standards Act as exempt, even when they perform nonexempt duties. Workers who had sedentary desk jobs had a lower risk of cognitive decline, compared with those whose jobs required more physical activity, researchers reported in the International Journal of Epidemiology. People who had desk-based careers were more likely to be in the study's top 10% for cognitive performance, while those with jobs involving manual labor had almost three times the likelihood of developing poor cognition.
