YUM! Brands Recruiter Files ERISA Lawsuit over Misclassification
Los Angeles, CA On July 9, Tim Alders, formerly an Executive Recruiter for YUM Brands Inc. and Taco Bell Corp. filed an ERISA lawsuit alleging that the fast-food conglomerates deprived him of pension and other benefits by deliberately misclassifying him as an independent contractor, rather than an employee. Tim Alders v. YUM, Inc. is neither a standard-issue misclassification lawsuit (many of which are brought by hourly-wage workers, cheated of California wage protections) or a variation of now-familiar ERISA fiduciary breach action. Rather, it is creative combination of the two. The lawsuit makes painfully clear how much long-term contractors (even the well-paid ones) lose when they are paid as casual workers.

Washington Football Team to Pay $10 Million Plus Legal Fees to End Sexual Harassment Claims
Alexandria, VA On July 1, the NFL announced that it had fined the Washington Football Team $10 million plus fees and expenses incurred in the investigation of allegations of sexual harassment by female employees. The conclusions of the investigation have not been publicly released, and efforts to keep the underlying allegations secret have sparked more lawsuits. The team and individuals who worked in front office seem desperate to bury the evidence, which is curious given the already thorough public reporting of sexual harassment and an atmosphere of bullying and intimidation. Activists have sought public release of the results of the investigation. In 2018 Houston Texans cheerleaders made unpaid wages claims. Is this part of the story, or is there evidence of something else?

Minor League Baseball Players Sue for Unpaid California Wages
San Francisco, CA On July 23, the U.S. Magistrate sitting in the Northern District of California narrowed the subclass of plaintiffs who may seek injunctive relief in Senne v. Office of the Commissioner of Baseball. The lawsuit that makes claims under California prevailing wage laws among other state and federal statutes. The minor leaguers allege that they are paid far less than the minimum wage required under the California Labor Code, Sections 1182 and 1197 and, for long periods of time, required to work for no wages, at all.

ABM Industries to Settle Janitors’ Wage Lawsuits for $140 Million
San Francisco, CA On July 8, ABM Industries entered into a written agreement to settle the consolidated lawsuits, ABM Industries Overtime Cases (also known as the “Bucio case”), pending in the Superior Court of California, County of San Francisco. Filed in 2006, the lawsuits allege that ABM’s prior timekeeping and payment practices shortchanged as many as 50,000 janitorial employees in violation of the California Labor Code. Under the terms of the proposed settlement, ABM will pay a total sum of $140 million to resolve all claims. The settlement remains subject to court approval.

Another Monsanto Roundup Lawsuit filed in California
San Francisco, CA Monsanto has been hit with another lawsuit claiming its Roundup product causes non-Hodgkin’s lymphoma and other cancers. Plaintiff Michael Langford of Sacramento was diagnosed with Non-Hodgkin lymphoma in 2007 and later developed other cancers. Langford’s Monsanto lawsuit filed in late June comes on the heels of a claim also filed in June. An Ohio resident filed suit in Delaware Superior Court claiming her non-Hodgkin’s lymphoma was also the result of many years’ exposure to Roundup in the care of her home garden.
